Marquis Lewis, the man who allegedly attacked Brittny Gastineau, was himself badly injured during their altercation and claims it was a case of mutual combat.
The famous street artist, who goes by the name Retna, was dating Brittny. He checked into the London Hotel in West Hollywood a week ago Monday.
He was recuperating from major knee surgery, which had just been performed. His lawyer, Michael Goldstein, says Brittny came to visit the next day.
Fast forward a week later and the socialite is parading her black eye around West Hollywood begging for attention and hoping it will be photographed.
Citing a major argument, Goldstein says his client was almost defenseless from the physical attack because he was unable to walk without crutches.
Retna was also seriously injured, says the attorney, with his face and eye swollen, his eat all cut up and his painting hand injured in the incident.
Goldstein says unequivocally, "Retna was not the aggressor."
That said, he harbors no ill will, calling Brittny "sweet" and says "they're cool with each other" despite what sounds like a brutal, physical altercation.
To hear Goldstein tell it, Retna and Brittny are in the process of resolving their differences and he's shocked Brittny made a spectacle in Hollywood.
Her BFF Kim Kardashian had no comment at press time.
